TITLE TO GOODS
|
|
|
Title to products sold hereunder passes to Buyer and SouthernBiotech's liability as to delivery thereof ceases upon
SouthernBiotech's delivery of such products in good condition to the carrier at SouthernBiotech's shipping point,
the carrier acting as the Buyer's agent.

|
RETURNED GOODS AUTHORIZATION POLICY
|
|
No product shall be accepted for credit or replacement without
SouthernBiotech's prior authorization. Please
contact our Customer Service
Department to receive information or a returned goods authorization (RGA)
number. When requesting return authorization, please refer to:
- Purchase order number
- Invoice number
- Catalog number and product description
- Product lot number
There is no provision for credit for outdated material. Goods
must be returned in the same condition as received and within fourteen (14) days
of the SouthernBiotech shipment date. Returned products are subject to a restocking fee equal to 20% of the purchase price.

LIMITED WARRANTY
|
|
|
SouthernBiotech only warrants that, at the time of shipment, the products sold are free from defects in material and
workmanship and conform to specifications which accompany the product. SouthernBiotech makes no other warranty, expressed
or implied, with respect to its products, including any warranty of merchantability or fitness for any particular purpose.
Notification of any breach of warranty must be made within 30 days of receipt of material, unless otherwise provided in
writing by SouthernBiotech. No claims shall be honored if the customer fails to notify SouthernBiotech within the period
specified. The sole and exclusive remedy of the customer for any liability of SouthernBiotech of any kind, including
liability based upon warranty (expressed or implied, whether contained herein or elsewhere), strict liability, contract
or otherwise, is limited to the refund of the invoice price of the goods. SouthernBiotech shall not in any case be liable
for special, incidental, or consequential damages of any kind.

BUYER'S TERMS AND CONDITIONS
|
|
Any terms or conditions of any Buyer’s purchase order or other instrument which are in addition to or inconsistent
with the terms and conditions set forth herein shall not be binding on SouthernBiotech and shall not apply to this
sale. The Buyer shall not assign any interest or right herein without first obtaining the written consent of
SouthernBiotech. The validity, performance and construction of these terms and conditions and of any transaction
or sale to which they relate shall be governed by the laws of the State of Alabama.
A packaging and shipping charge will be prepaid and added to your invoice. Shipments are normally via Federal
Express or similar carrier unless otherwise mutually agreed to in writing prior to shipment.
